Counter-assisted filing resumes for CIVIL FILINGS in the Wake County Courthouse (316 Fayetteville Street) First Floor Civil District and Superior Room 102 and Small Claims Room 119 - (Update 1.16.21) Counter Assistance is available for CRIMINAL 8:30 am to 5 pm ONLY Wake County Justice Center (300 S. Salisbury Street) First Floor Criminal District Room 1000 and Second Floor Criminal Superior Room 2000. Drop off filings are appreciated.
For your Safety and ours we reserve the right to limit the number of counter-assisted filings as well as our time availability in assisting the filing.

Clerk's Office - Estates
(STRONGLY ENCOURAGE DROP OFFS FOR INVENTORY and ACCOUNTINGS) Estates Division Appointments and Walk ins for Qualifications and Motions are on the (12th Floor of the Wake County Courthouse, 316 Fayetteville Street, Raleigh current hours are from 8:30 am to 5:00 pm. (updated 9.25.21) eCourts Guide & File is available for certain estates filings at https://northcarolina.tylertech.cloud/SRL/SRL. In addition, the Clerk's Office created self-help packets for most estates filings. Electronic forms are available by submitting an email request to wake.estates@nccourts.org. Self-help packets are also available in hard copy in the lobby of the Estates Division. Counter Assisted Filing is available, however drop off filings are strongly encouraged.
Requests for copies of files may be emailed to wake.estates.copyrequest@nccourts.org. Attorneys and members of the general public who need to conduct research for real estate closings are TO BOOK AN APPOINTMENT PLEASE VISIT OUR SCHEDULING WEBSITE.
Small Claims Court
Courtrooms 3A, 3D, and 3C will resume operations January 21, 2021 for small claims proceedings.• Small claims remote hearings will continue, upon request and approval of the presiding Magistrate.
Wedding Ceremonies
Location: Wake County Justice Center - Updated 5.31.22 - Walk In Only - Due to the increase in volume - no apportments only walk ins.
Hours: Monday – Friday 9:30 am-12 pm and 1:30 pm - 4 pm Monday thru Friday Ceremonies are every half hour please arrive as schedule (appointment)
Courtroom 901 Wake County Justice Center - A strict limit of 6 individuals, including the couple getting married, are allowed to be in attendance. Couples seeking to be married by a Magistrate must first obtain a valid marriage license from a North Carolina Register of Deeds Office.
Domestic Violence Court / Family Court
Domestic Violence Court: Courtroom 5A & 5B (Wake County Courthouse) is Open. Domestic Violence filings are accepted from 8:30 am to 4 pm on the fifth floor of the Wake County Courthouse Room 527. Daily calendar calls will be held remotely via WEBEX at 9:00 am at the following WebEx locations:
- Motions to Continue can be made by sending an email to WakeDVClerk@nccourts.org prior to the hearing date. All emailed Motions to Continue shall contain the following information:Names and any know contact information of parties.
- Names and contact information of any attorneys representing a party
- Basis of motion to continue (illness, potential exposure to COVID-19, underlying health concerns, pending criminal charges, or any other reasons related to Chief Justice's Directive);
- Requested dates for rescheduled hearing.

Divorces
**NOTICE OF HEARING FEE WITH MOTION FOR SUMMARY JUDGMENT - $20**
You must file a motion for summary judgment and serve it on the other party at least 10 days prior to the hearing.
Contact WakeCountyDivorce@nccourts.org to obtain the next available date for your Motion for Summary Judgment Divorce. Complete the appropriate portions of the Notice of Hearing (WAKE-DOM-23B) and take three (3) copies to the Clerk's Office located on the 1st floor of the Wake County Courthouse. Have all three copies file stamped. Leave one copy with the Clerk, serve one copy on the opposing counsel/party, and keep one copy for your records. This Notice must be served on the opposing counsel/party at least 5 business days prior to the scheduled hearing (excluding weekends or court holidays). See Rule 5 of the North Carolina Rules of Civil Procedure.
On the date designated in blank #1 on the front of the Notice of Divorce Hearing form, use WebEx.com and go to Wake Divorce Meeting Room (ID # 126 101 9327) at 9:00 a.m. Please email copies of your completed JUDGMENT FOR ABSOLUTE DIVORCE, SCRA Affidavit/Declaration, and Certificate of Absolute Divorce to WakeCountyDivorce@nccourts.org by 5:00 p.m. on the Tuesday prior to the Summary Judgment hearing. If the clerk does not receive your documents, the motion for summary judgment will not be heard. Parties may object to having a remote hearing by mailing or emailing written objections to the clerk at WakeCountyDivorce@nccourts.org at least two (2) days before the hearing. Written objections should include the names of the parties, the file number, and the basis for the objection. If the court finds good cause for the objection to the remoteness of the hearing, in the discretion of the judge, it may be heard as a live summary judgment divorce at 10:30 a.m., or it may be reset for trial on a future court date.
The personal meeting room can be accessed by going to www.WebEx.com and selecting the "JOIN" tab. Type in the meeting ID number listed above in the WebEx "Join" box. Make sure your video and audio are working properly before selecting "Join the meeting." Mute your microphone until your case is called for hearing. The earliest date your divorce hearing may be scheduled is the first FRIDAY 41 days AFTER the Summons and Complaint were served on your spouse. If that date falls on a Court holiday, you will need to select another Friday. The Clerk's Office staff will provide you with the first available date. If you arranged for Sheriff's service, you will receive a small white card from the Clerk of Superior Court showing the date of service. If you chose a different method of service, you will need to provide proof to the Court as to when you served the Defendant. See Rule 4 Instructions for Initial Service of the Summons and Complaint on Defendant.
Complete the appropriate portions of the Notice of Divorce Hearing given to you by the Clerk's Office. The Clerk will make two copies and will file stamp all three copies. Leave one copy with the Clerk, serve one copy on your spouse, and keep one copy for yourself. This Notice must be served on your spouse at least 5 business days prior to the scheduled hearing (excluding weekends or court holidays). Service of this Notice may be made by sending it via U.S. mail in a properly addressed envelope, postpaid, to your spouse's last known address, by delivery to your spouse's attorney of record, or by hand delivery to your spouse. See Rule 5 of the North Carolina Rules of Civil Procedure.
On the date designated in blank #1 at the time listed on the front of this form, go to the specified courtroom (9C, 2B, or 2A) and be seated. Defendants who do not object to the proceedings and do not wish to speak to the judge may prefer to watch the hearing remotely via WebEx at Wake Divorce Personal Meeting ID# 126 101 9327. The person seeking the divorce should bring THREE copies of the JUDGMENT FOR ABSOLUTE DIVORCE. At the hearing, you will be given a Certificate of Absolute Divorce that must be filled out on the date of the hearing in Black Ink. If you are appearing remotely to observe, the personal meeting room can be accessed by going to www.WebEx.com and selecting the "JOIN" tab. Type in the meeting ID number listed above in the WebEx "Join" box. Make sure your video and audio are working properly before selecting "Join the meeting."
